A specimen order and the other standard subcontract terms had not been incorporated into the subcontract. There was no reliable evidence that there had been any agreement that they would be incorporated into it. There was no written record that Bestwood had received these documents. The court was satisfied that there was no written contract and that the adjudicator did not have jurisdiction over the dispute.
