Changing economic conditions increase importance of construction insolvency law
Fourth edition of Construction Insolvency provides ultimate information source book for legal, construction and insolvency practitioners.
Against a backdrop of difficult trading conditions in the construction sector, international law firm Pinsent Masons today announced the publication of the fourth edition of Construction Insolvency: Security, Risk and Renewal in Construction Contracts by Richard Davis, consultant with Pinsent Masons LLP.
Completely updated from the previous edition, Construction Insolvency incorporates all recent drivers and developments in the area. These include the impact of cases stemming from the insolvency of Lehman Brothers along with developments on the interface between insolvency law and the adjudication procedure.
The book, which concerns the effect of insolvency on the parties to a construction project, is widely recognised as the key source for information in this area and is the distillation of over 25 years of practice and research, following the Insolvency Act 1986.
Covering a wide range of international and UK cases, highlights of the changes in the new edition include:
1.How insolvency has placed limits on the scope of the adjudication procedure
2.The impact of cases on insolvency in the financial sector on construction insolvency
3.The growing influence of international cases, such as those from Australia, on UK judgements
4.How the project bank account is developing against the background of the law on construction trusts
5.Review of recent research into the causes and indicators of insolvency
“Given current market conditions knowledge of insolvency law and practice within the international construction industry is of paramount and growing importance,” said Andrew Hibbert of Pinsent Masons, lead partner in the commissioning of the book. “Construction Insolvency can make a real contribution to the law by bringing together materials from a wide variety of sources, analysing them, and presenting the results in a format which is easy to follow. Richard’s in-depth approach reveals unexpected links between apparently disparate areas and helps us to think in new ways about familiar topics.”
