The service entails the collection of South Hams District Council’s Garden Waste from their stockpile location in Devon and haulage of the same to the service provider's waste composting point(s) for composting. The service provider shall then compost the collected contract waste.

The contract is not divided into lots as the service can only be undertaken by one service provider.

II.2.4)Description of the procurement:

South Hams District Council plan to roll out their seprate collection of garden waste from the service commencement date identified in the tender documents have and therefore the available tonnage records are limited. However, it is anticipated that, subject to seasonal changes, the District Council will collect around 4 000 tonnes per annum of garden waste.

The successful service provider will be required to collect South Hams District Council's garden waste from their waste transfer facility in Devon and transport the collected garden waste to their composting point where the waste shall be composted to standards set by PAS 100.

Devon County Council reserves the right to cancel or withdraw from the procurement process at any stage.

Devon County Council does not bind itself to accept the lowest or any tender and reserves the right not to award a contract. Devon County Council reserves the right to award the contract in part or to call for new tenders should it consider this necessary.

Economic operators are solely responsible for their costs and expenses incurred in connection with the preparation and submission of their tenders and participation in this and all future stages of this procurement process. Under no circumstances will Devon County Council be liable for any costs or expenses incurred by economic operators or any of their supply chain, partners or advisers in this procurement process. This is the case even where Devon County Council abandons the procurement process for any reason.

Documents and bids for this procurement process will be prepared in the English language. The procurement process and subsequent contract will be subject to English law and the exclusive jurisdiction of the English courts. Any contract entered into as a result of this contract notice shall be considered as a contract made under English law and subject to the exclusive jurisdiction of the English courts.

If economic operators consider that any information made available to Devon County Council is commercially sensitive, they should identify it and explain (in broad terms) what harm may result from disclosure and the time period applicable to that sensitivity. Even where information made available to Devon County Council is marked commercially sensitive, Devon County Council shall be entitled (acting in its sole discretion) to disclose it pursuant to a request. Please also note that information marked ‘confidential’ or equivalent by economic operators does not bind Devon County Council to any duty of confidence by virtue of that marking and Devon County Council will not be liable to economic operators for breach of confidentiality or otherwise if Devon County Council discloses such information pursuant to a request.
