II.2.4)Description of the procurement:

Portsmouth City Council — the ‘Council’ — is seeking tenders to appoint a principal contractor to undertake a specialist marine Ground Investigation (GI) works within Tipner Lake/Porchester Lake, Tipner West and Horsea Island, Portsmouth in order to progress the Tipner West Regeneration Project. The Principal Designer role will be undertaken by Savills plc.

The estimated value of the contract is approx. GBP 3 million and will be let on a single stage re-measurable ICE Specification for Ground Investigation Second Edition with Bill of Quantities prepared by the Site Investigation Steering Group for all Works.

The deadline for tender submission is 18 December 2020 at 12 p.m. with award of contract following on 26 January 2021. The works period is significantly constrained by bird migration and breeding patterns meaning that works may only commence from mid/late March 2021 and must be complete by mid May 2021. However it should be noted that this works period may be subject to review and as such the Council will require flexibility from the appointed contractor in the event that these dates need to be moved forward or backwards.

The services of a specialist ground investigation contractor are required to undertake specialist intrusive marine ground investigation survey required to inform the proposed development. Specifically, the GI works are required to provide information to support design of the proposed reclamation infilling; design of the perimeter River Wall; support the design of the proposed Horsea Island Bridge; and assessment of sediment quality and composition of proposed dredging operations.

The ground investigation will comprise overwater investigations and will be carried in the following order:

1) Tipner West Land Reclamation;

2) Tipner to Horsea Bridge Link;

3) Quay Wall Replacement;

4) Dredged Channel;

5) Horsea Foreshore.

The works are to be undertaken predominately on the Intertidal Zone and within the existing SSSI and SPA. As such all works will therefore need to be undertaken in a highly controlled manner to avoid impacts to Marine Ecology. An MMO application for the GI Works is currently being undertaken by a Marine Projects.

In addition to general investigation activities as stated within the specification the scope of the appointment will also cover the following:

• onsite inspection and logging of samples;

• in-situ testing in boreholes;

• chemical and geotechnical sampling in exploratory holes;

• laboratory geotechnical testing of soils and rock and chemical testing of soil and groundwater samples; and

• UXO survey of all overwater exploratory holes.

The contract will be let in general accordance with the Open Procedure as defined within the Public Contracts Regulations (2015). However, as the contract in question is a works contract with an estimated value which falls below the relevant current statutory threshold it should be noted that publication of this OJEU Contract Notice is in the interests of promoting transparency, equality of opportunity and competition and as such does not place any legal obligations on the part of the Council in respect of adherence to the Public Contracts Regulations (2015) beyond the general provisions set out for below threshold contracts.

Description of options:

The works period is significantly constrained by bird migration and breeding patterns meaning that works may only commence from mid/late March 2021 and must be complete by mid May 2021. However it should be noted that this works period may be subject to review and as such the Council will require flexibility from the appointed contractor in the event that these dates need to be moved forward or backwards.

This will require the contractor to work in a spirit of mutual trust and cooperation in order to assist the Council in meeting its objectives. Where variation of the contract is required post award the Council will require that irrespective of the contract terms that any changes to cost, programme, method, etc. are presented on an evidenced open book basis and that the contractor engages with the Council pro-actively to minimise the impact of any such variations.

Conversely the contractor will also be expected to engage with the Council to help identify any improvements that can be made in respect of method, programme, risk, etc. post award though objective focused partnership working.

TW&HIE represents the largest area of undeveloped and underused land in a city at 31.4 hectares (ha), whilst the wider Strategic Development Area (SDA) also incorporates the reclamation of circa 27 ha from Portsmouth Harbour in order to deliver the scheme. The SDA proposal for TW&HIE therefore incorporates a total of 59 ha (145 acres), across the two sites linked by a proposed bridge and allowing for a significant mix of development, including 10 ha of marine employment and up to 4 000 homes.

The Proposed Development comprises reclamation of circa 27 ha of land from Portsmouth Harbour, to create a Site of circa 59 ha (excluding the airborne bridge elements), and comprehensive development of the site, delivering up to 4 000 residential dwellings, circa 10 ha of employment land, the associated access, parking, and public transport interchange, community facilities including a primary school and education, and supporting amenity space, landscaping, green infrastructure and sustainable drainage systems and energy, waste and utility provisions and a bridge link connecting Tipner West (TW) with Horsea Island East (HIE).

The Ordnance Survey National Grid Coordinate for the centre of the Site is 463378E 103291N.

The existing land at Tipner West and Horsea Island East are former MOD land. The vast majority of Tipner West is used for a firing range, with a small amount of the land used for sailing clubs, a school and some industrial port uses. Horsea Island East is predominantly unused with a landfill to the north and existing MOD land to the west.

There are several areas to gain access to the water from Tipner West and the surrounding area. Most notable are two slip ways from the Portsmouth Harbour Cruising Club in the north west and the boating club in the south east. Entrance to Tipner West is off of the M275 motorway onto the Tipner Interchange roundabout.
