0792 Bellhouse Closed Landfill Generator — Management and Energy Contract
Essex County Council (the ‘Authority‘) is the operator of the Bellhouse Closed Landfill Site (the ‘Site’), which is located in Stanway, Colchester. The Authority is responsible for the management and control of landfill gas emanating from the Site.
The Authority seeks to award a contract for the management of the landfill gas at the Site and generation of energy from landfill gas from the Site. Details of technical, safety, environmental permit, planning permission and other requirements are set out in the services specification available with the tender documents. The successful bidder must be able to meet the Authority’s timeline for the commencement of energy generation – there is a 20-week implementation and mobilisation timeline against which bidders will be required to bid. In return for the licence and access to the landfill gas, the successful bidder will be required to pay the Authority a 90 % share of any gross income received by the bidder from any renewable obligation certificates and a royalty based on the percentage of gross electricity sales revenue. Additional services may be added to this contract in order to better utilise the resources in relation to the landfill site and/or to maximise any spare capacity which can be exported to the electricity grid network.
Site visits are invited by appointment only to be arranged with the Authority during the tender process. All information and opportunity to respond will be via the e-sourcing portal (Proactis).

The Authority is seeking a provider to deliver the services set out as above. The specification includes: design, supply, operate and maintain landfill gas utilisation plant and ancillary equipment for the generation and sale of electricity; operate and maintain the landfill gas collection field to allow landfill gas utilisation and safe environmental control; operate within the boundaries of the environmental permit for the Site that places certain responsibilities and obligations upon the Authority; Operate within the boundaries of the planning consent for the generating station.
Bidders will be assessed on a 60:40 basis for price:quality in accordance with the evaluation and award criteria set out in the tender documents. The tender will be evaluated on Most Economically Advantageous Tender (MEAT) criteria. All award criteria and given in the tender documents.
Bidders will be required to submit a percentage for the royalty to be paid to the Authority. Quality questions will cover topics including: credentials in landfill Gas management, approach to installation, commissioning and energy generation, approach to operational management and maintenance, contingency and management plan in the event of service disruption and approach to innovation and social value. Bidders are required to pass the SQ in order for their submission to be considered.
Due diligence will be provided by the Authority. Any mismatch will be clarified by the Authority to the bidder, prior to contract award.
Up to an additional 5 years extension, exercisable at the Authority’s discretion and in such increments as the Authority deems necessary.

Sections II.1.5) the estimated value of the contract in this notice is not a representation by the Authority as to the levels of income which will be generated by this contract. The estimated contract value is inclusive of the potential to extend the contract and addition or expansion of services during the life of the contract. The Authority may also add any grant funding or other funding which becomes available to the Authority to the contract where such funding relates to the services and outcomes required under the contract and the Services Specification. The Authority does not guarantee or grant any exclusivity in relation to any such services or funding during the life of the contract.
Bidders are required to accept the terms of the draft contract issued with the tender – see the Bidder Guidance document issued with the tender documents for guidance on and requirements in relation to raising clarifications during the tender process.
Reserve bidder: the successful bidder is required to accept the 20-week deadline and the draft contract and proceed to completion of the contract as soon as possible following the end of the standstill period and completion of Authority governance to award the contract. The successful bidder is also required to comply with its proposals in relation to the engine it has specified, except where this has been made necessary due to circumstances beyond the bidder’s control. Failure to do so will entitle the Authority to withdraw the award to any such non-compliant bidder (or terminate the contract if already entered into due to a material breach of the contract) and award to the next highest scoring compliant bidder. Changes to the 20-week deadline and engine proposals prior to contract signature will only be agreed in circumstances beyond the successful bidder’s control.
