Dudley Metropolitan Borough Council is committed to providing services in relation to Gas Central Heating and Boiler Replacement to Council owned properties throughout Dudley Borough. The Invitation to Tender documentation intends to demonstrate the Council’s projected workload over the course of the contract. The Council is looking for a single contractor to provide these services for a continuous cycle of services over a 3 year period with an option to extend the Contract Period by any number of periods up to an aggregate of twenty four (24) calendar months.

II.2.4)Description of the procurement:

The contract will predominantly deliver:

The replacement of approximately 3 100 inefficient methods of heating (boilers and electric storage heaters) with new ‘A’ rated gas boilers (operating at 90%+ efficiency) that comply with Part L of the Building Regulations over an initial 3 year contract period. Where appropriate, ‘smart’ heating controls will be fitted providing a wealth of functionality that will further reduce energy use and carbon.

The thermostat will record a thermal profile for each house, along with a record of gas consumption and regular automatic feedback will be given to residents regarding how much energy they have used. The thermostat will provide data to the Council of how different heating systems are performing compared to predicted energy use from the Energy Performance Certificate (EPC). Allowing proactive boiler maintenance and identification of homes for future improvement programmes. In addition, some properties may require other associated plumbing, building, and testing of suspect asbestos surfaces. The majority of properties will be occupied whilst the works are carried out.

A number of the installations carried out under this contract are part financed by European Regional Development Funding (ERDF). The Council expressly reserves the right;

1) Not to award any contract as a result of the procurement process commenced by publication of this notice;

2) To make whatever changes it sees fit to the content and structure of the tendering competition;

3) To award contracts in respect of any parts of the requirement covered by this notice; and

4) To award contract(s) in stages and in no circumstances will the Council be liable for any costs incurred by candidates;

5) To award contracts for one, two or more lots without awarding contracts for all lots;

6) To abandon the procurement process due to reasons caused by a pandemic such as Covid-19 and other pandemics acts of God classed as Force Majeure fitting criteria of global pandemic according to WHO, Public Health England (PHE) which makes it impossible to continue with procurement process or contract performance;

7) The Council reserves the right not to award the contract to where it deems bids received are abnormally low to the pre-tender estimate after carrying due diligence test in line with PCR (2015) Reg.69;

8) The Council reserves the right to modify the contract during its term in line with conditions provided for in PCR (2015) Reg.72, in circumstance where it is impossible to carryout further competition for parts of contract which have become necessary, but where not previously included in the initial call for competition.

The Council will always take legal advice from procurement lawyers in exercising these rights to ensure that competition is not stifled and provide equal treatment of all economic operators. Neither the Council is to be liable for any costs, fees or expenses incurred by any party expressing any interest in or participating in this procurement process. The Council is subject to the Freedom of Information Act 2000 and the Environmental Information Regulations 2004. All information received will be dealt with in accordance with that Act and information to which the environmental information regulations apply will be dealt with in accordance with those regulations.

The Council gives notice that within this tender an unequivocal review clause or option has been included in the event of any universal or partial succession into the position of the initial contractor, following corporate restructuring, including takeover, merger, acquisition, administration or insolvency.
