Justification for not publishing a preliminary market engagement notice
Prior to issuing this procurement Stantec on behalf of Kings Lynn IDB (the Contracting Authority) undertook limited pre procurement market engagement with a number of suppliers to inform budget development, technical feasibility and procurement planning activities.
These pumping stations fall under the Eel Regulations 2009 and the pump station owner is required to obtain an eel exemption notice from the Environment Agency due to abstraction volume. Our understanding is there are only 4 manufacturers that the EA will accept.
To ensure compliance with the principles of transparency, equal treatment and fair competition, the CA has reviewed information shared during that engagement and has included within the procurement documentation all information considered material to the preparation of tenders. The Authority considers that these measures are sufficient to ensure that no supplier participating in the earlier engagement benefits from an unfair competitive advantage
