Competitive flexible procedure description
London Borough of Hackney Council (LBH) is commencing a Competitive Flexible Procedure to deliver Parcel Locker Services under a Concessions contract. The procurement is organised into the following steps;
Step 1. Preliminary Market Engagement - A 3 week Preliminary Market Engagement and consultation exercise was completed in July 2026
Step 2. (Stage 1) Conditions of Participation and Procurement Specific Questions - Shortlisting :
This tender notice is issued alongside the Procurement Specific Questionnaire, launching Stage 1 Conditions of Participation and Procurement Specific Questions. Conditions of Participation will be evaluated on a Pass/Fail basis, and Procurement Specific Questions will be scored. Up to seven Bidders will be shortlisted to progress to Stage 2.
Step 3. (Stage 2) Invitation to Submit a Proposal
The second stage of the process will invite all shortlisted Bidders from Step 2 to Invitation to Submit a Proposal. All bids will be evaluated in line with the published evaluation criteria.
Step 4. (Stage 3) Post IST Negotiation
At this stage 3, following the evaluation of the tender submissions received from Bidders in Stage 2 above, LBH may request or issue a number of clarifications, developments or refinements as may be required and permitted, including issuing commercial clarifications to level commercial assumptions and or providing all Bidders with baseline Locker and usage numbers for commercial submission evaluation purposes.
The purpose of the negotiation stage is to clarify, develop or refine the Tender Documentation within the published scope and, where appropriate, to obtain Final Tenders/Best and Final Offers from the participating Bidders.
During step 4 Bidders may be required to participate in a Presentation of their submitted proposal. This will be an opportunity to amplify their submitted bid, and not add any additional or new information. Bidders' presentations will follow their Quality Question Responses and Commercial Question Responses only. No additional information will be permitted in the presentations.
Where any clarifications, developments or refinements have been agreed, an ITSP will be issued again, with the relevant updates. This will be issued to all Bidders who were shortlisted from the previous stage.
Bidders will be requested to return their submission, in line with any agree clarifications, developments or refinements. Updated Tenders must be submitted by the set return date, which will be displayed within the eProcurement portal. Following receipt, Bidders tender evaluations will be updated accordingly. Overall Procurement scores will be ranked in accordance with the highest score.
At this point (and at any point) it is envisaged that; either (i) where a sole bidder returns, the Council will cease the procurement process and make an award (subject to assurances and due diligence), or (ii) the Council may ask the top two scoring bidders for a Best & Final Offer (BAFO) within a defined period, ending any further negotiation and seeking final updated proposals.
However the Council reserves the right to repeat this step (5) until all clarifications, updates and amendments have been addressed as to ensure a deliverable contractual agreement.
The basis of any award will be the objective and transparent assessment and evaluation of the Most Advantageous Tender in accordance with the published Award Criteria and Evaluation
Methodology.
The Council may negotiate with a sole remaining Bidder or with multiple participating Bidders, in accordance with the published procedure and any applicable down selection rules. Any selection of Bidders for negotiation will be based on the published process and criteria and will not be made on an unstructured discretionary basis.
Step 6. (Stage 4) BAFO & Award
Following the end of the negotiation process, and/or any BAFO received, a final evaluation update of bids will be undertaken to provide final scores for each Bidder. Assurance and Due Diligence checks will be made, and one successful bidder will be selected as the MAT Bidder for consideration to award. The Council reserves the right to not award any contract, at the discretion of the Council.
Step 7. Formal entry into a sealed contract
Following selection of the successful Bidder a formal award process will be required, to enable formal internal governance and approval procedures, before seal of the Concession contract can occur.
