II.2.4) Description of the procurement

The Secretary of State for Defence (the “Authority”) intends to award a Supply contract to Rolls-Royce Solutions Ltd for the provision of a Last Time Buy (LTB) of Air Circuit Breakers (ACB). The Contract has an estimated value of £10M (incl. VAT).

In accordance with regulation 4 of The Defence and Security Public Contracts (Amendment) (EU Exit) Regulations 2019 (SI 2019/697) this procurement falls to be regulated under the provisions of the Defence and Security Public Contracts Regulations 2011 as amended (in particular by SI 2019/697 and SI 2020/1450). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate. It is considered that the award of the contract without prior publication of a contract notice in the UK e-notification service (as required by the relevant legislation) is lawful in accordance with Regulation 16(1)(a)(ii) of the DSPCR 2011 for technical reasons. It is believed that the services to be provided under the contract can only be supplied by Rolls-Royce Solutions Ltd as the Design Authority (DA). Rolls-Royce Solutions Ltd designed, specified and manufactured all the switchboards for A-Class platforms, this included the specification and design of circuit breakers intrinsic to the switchboard.

Rolls-Royce Solutions Ltd sourced the ACBs from ABB. The ABB ACB was selected by Rolls-Royce Solutions Ltd as the only available ACB that would meet platform requirements safety, integration and spatial specifications.

There is no effective alternative supplier for the ACB’s that could conduct the required work on the equipment, only these can meet the required safety standards to prevent single failure. Equally the SQEP and technical documentation is placed with the DA (Rolls-Royce Solutions Ltd) and as such they are best placed to execute this technical knowledge to meet the Safety and Quality specifications to meet platform requirements.

Only the original switchboard DA (Rolls-Royce Solutions Ltd) currently have the knowledge and expertise to execute the engineering works and procurement activities with ABB.

Therefore, the Authority considers that in order to maintain the safety of the platform and personnel only Rolls-Royce Solutions Ltd are able to supply the ACBs supplied from ABB and as such contracting with Rolls Royce is essential.

Explanation:
