A London developer and a contractor have been fined a total of £25,000 after a worker fell to his death at a construction site in Essex in March 2007.
Otari Davidovich Hudoyan, of east London, was working on a site in East Hall Lane, Rainham. On 28 March 2007, his body was found on site and an investigation found he had suffered fatal injuries that were consistent with a fall from height.
There were no witnesses to the incident.
The Health and Safety Executive prosecuted property developer Kemal Has and principal contractor Ali Aslan. The HSE said Aslan had failed to ensure work was carried out in a safe manner, and had also failed to ensure his workers had adequate training.
Has, as the client, failed to produce health and safety information for the contractor about the nature of the building, and had also failed to appoint a competent principal contractor, the HSE said.
The Old Bailey heard the site had a number of risks to workers, including where the floors and roofs had been stripped out.
HSE inspector Helen Donnelly said: “This is a shocking and appalling example of a property developer and a contractor both disregarding the law, leading to a worker’s death.”
Aslan, of Haringey, pleaded guilty to breaching the Health and Safety at Work etc Act and was fined £10,000 and ordered to pay costs of £8,038.
Has, of Walthamstow, also pleaded guilty to breaching the Act and was £15,000. He was also ordered to pay costs of £8,038.
